1. Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of the BharatKhelo mobile application and website (collectively, the “Service”), operated by Golden League (“Golden League”, “BharatKhelo”, “we”, “us”). In these Terms, “we” and “us” also include our directors, officers, employees, affiliates, partners, licensors and service providers.
2. Eligibility and accounts
You must be legally able to enter into a contract under Indian law. If you are under 18, you may use the Service only with the knowledge and consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Service. You are responsible for safeguarding the verification codes or password you use to access the Service and for all activity under your account. You must notify us immediately of any unauthorized use of your account.
3. Use of service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other person’s use of it.
4. Our role as a platform
BharatKhelo is an online platform that connects athletes, coaches, academies, sports bodies, event organisers and other users. We act as an intermediary. We do not create, select, edit, endorse or verify content that users post, and we are not a party to any arrangement, registration, payment, training, employment, membership, competition or other dealing between users. Academies, organizations and event organisers listed on the Service are independent of us and are solely responsible for their own services, fees, events, rules and decisions.
5. User content, comments and conduct
“User Content” means anything a user submits, posts or sends through the Service, including profiles, photos, videos, documents, posts, comments, reviews, ratings, messages and chat.
- You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, use, reproduce, adapt, publish, translate, distribute and display it in connection with operating and promoting the Service.
- You alone are responsible for your User Content, including its accuracy, legality and the language you use. You confirm that you own it or have all necessary rights, consents and permissions, including those of any person shown in it.
- Views, opinions, comments, reviews and statements posted by users are theirs alone. They do not represent the views of Golden League or BharatKhelo, and we do not adopt or guarantee them.
- We do not monitor all User Content and have no obligation to do so. We may, but are not required to, remove or restrict content or accounts at our discretion or as required by law.
6. Prohibited activities
The following are strictly prohibited on the Service:
- Posting false, misleading, defamatory, obscene or unlawful information
- Impersonating another person or entity
- Harassment, bullying, abuse, hate speech or content that promotes violence or discrimination
- Sharing another person’s private information or images without their consent
- Attempting to gain unauthorized access to accounts, systems or data
- Scraping, reverse engineering or misusing the Service or its data
- Violating any applicable law or the rights of any person
7. Sports activities and dealings between users
Sport, training and competition carry inherent risk of injury and loss. Any decision to train, play, register, travel, pay, meet or otherwise deal with another user, academy, organization or event is made entirely at your own risk. We do not supervise, inspect, insure or guarantee any academy, coach, athlete, official, event or venue, and we are not responsible for any injury, death, loss, dispute, fee, refund, selection decision, ranking, result or conduct arising from them. Any dispute is between the users or organizations concerned.
8. Accuracy and verification
Information on the Service is provided by users and organizations. Badges, verification marks, licence numbers, affiliations and ratings reflect information supplied to us and are not a guarantee of identity, qualification, safety, recognition or quality. You should verify information independently before relying on it.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
10. Limitation of liability and no claims
TO THE FULLEST EXTENT PERMITTED BY LAW, GOLDEN LEAGUE AND BHARATKHELO ARE NOT RESPONSIBLE OR LIABLE IN ANY WAY FOR ANY USER CONTENT, COMMENTS, REVIEWS, MESSAGES OR LANGUAGE POSTED BY ANY USER, OR FOR ANY OFFENCE, HURT, DEFAMATION, EMOTIONAL DISTRESS, REPUTATIONAL HARM OR OTHER HARM CAUSED TO ANYONE BY THEM. NO DAMAGES, COMPENSATION OR CLAIMS OF ANY KIND MAY BE MADE AGAINST US FOR SUCH MATTERS.
IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OPPORTUNITY OR OTHER LOSSES, OR FOR ANY INJURY OR LOSS ARISING FROM SPORTING ACTIVITY, OR FROM ACTS OR OMISSIONS OF OTHER USERS OR THIRD PARTIES, OR FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE OR ANY OTHER THEORY. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Indemnity
You agree to defend, indemnify and hold harmless Golden League and BharatKhelo from any claim, loss, liability, damages, costs and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your dealings with other users or your breach of these Terms or any law.
12. Reporting, removal and termination
If you see content that violates these Terms or the law, report it to [email protected] with a link and a description, and we will review it in line with applicable law. We may remove content and suspend or terminate access to the Service at any time, with or without notice or liability, including for breach of these Terms. On termination your right to use the Service ends immediately.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how your data is collected, stored and used.
14. Governing law and disputes
These Terms are governed by the laws of India. Subject to applicable law, the courts in India shall have exclusive jurisdiction over any dispute arising from these Terms or the Service.
15. Changes and general terms
We may update these Terms from time to time; continued use after an update means you accept the updated Terms. If any provision is found unenforceable, the remaining provisions stay in effect. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
